This syllabus covers 2 hourly seminars over 5 weeks. The course aims to introduce you to the sources and techniques of the English common law, from a substantive and methodological viewpoint. The themes include: an overview to common law reasoning and legal actors; how to find the law, how to do legal research and use online resources; precedent and reasoning by analogy in theory and practice; judicial law-making and the significance of dissenting opinions; the position of the UK Supreme Court in a globalised world.
The objective of the course is to provide you with a methodological and reasoning toolkit so that you know where to find the documents you may need, how to make sense of them, how to compare them to other legal documents you might be more familiar with. The course also aims to help you identifiy the distinctive features of the common law so that you feel comfortable with common law reasoning as a reader, a user -- and maybe, in a few years' time, a producer of common law documents.
